Terms of Service
The terms that govern your use of SafetySmartAI
By accessing or using SafetySmartAI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
SafetySmartAI is an AI-powered tool designed to assist EHS (Environment, Health, and Safety) professionals, leaders, managers, and supervisors. It is not a substitute for professional judgment, legal advice, or certified safety consulting.
In these Terms, "SafetySmartAI," "we," "us," and "our" refer to National Safety Consultants Inc., the company that owns and operates the Service. "You" refers to the user or organization accessing or using the Service.
SafetySmartAI provides AI-generated content including safety documents, research summaries, hazard analyses, and formula calculations. All content is generated by artificial intelligence and is intended to serve as a starting point or reference — not as definitive legal, regulatory, or safety advice.
The Service is available in Free, Professional, and Enterprise tiers, each with different usage limits and features as described on our Pricing page.
AI-generated content may contain errors, inaccuracies, or outdated information. Users are solely responsible for:
- Verifying all AI-generated content against current regulations, standards, and best practices
- Consulting qualified EHS professionals, legal counsel, or regulatory bodies before implementing any safety program, policy, or procedure
- Ensuring compliance with all applicable local, state, federal, and international laws and regulations
- Applying professional judgment when using any output from SafetySmartAI
SafetySmartAI, its creators, and affiliates shall not be held liable for any injury, illness, death, property damage, regulatory penalty, or other harm resulting from reliance on AI-generated content.
Important — uploads are processed by third-party AI: Any document, image, or content you upload to SafetySmartAI may be transmitted to third-party AI providers for processing and analysis. Do not upload anything you cannot lawfully or contractually share with a third party. SafetySmartAI does not guarantee the confidentiality of uploaded content once it leaves our infrastructure.
Paid subscriptions are billed monthly and renew automatically unless cancelled. All payments are processed securely through Base44 Payments.
Free tier users receive 30 lifetime searches (3 per major area). Professional users receive 150 searches per month and Pro Plus users receive 400 searches per month; Enterprise allowances are set with your account team. Paid allowances refill automatically at the start of each monthly billing period, while free lifetime searches do not reset.
Refunds are handled on a case-by-case basis. Please contact support for refund requests within 7 days of billing.
You agree not to use SafetySmartAI to:
- Violate any applicable laws or regulations
- Generate content intended to harm, mislead, or defraud others
- Attempt to circumvent usage limits or access controls
- Resell or redistribute AI-generated content as your own proprietary product without disclosure
- Upload any proprietary, confidential, or third-party copyrighted documents that you do not have the right to share
- Use the Service to produce instructions, plans, or guidance for illegal, violent, or inherently dangerous activities
- Upload malware, viruses, or any malicious or harmful code
- Upload personal data of third parties (including employee names, IDs, or health information) without proper authorization or consent
- Use the Service for any purpose other than legitimate environmental, health, and safety (EHS) activities
Content generated by SafetySmartAI using your inputs is provided for your use. SafetySmartAI retains rights to the underlying models and platform. You retain ownership of any original content you input into the system.
You are solely responsible for all content you upload, submit, or generate through SafetySmartAI, including its accuracy, legality, and your right to share it. You warrant that you have all necessary rights, consents, and permissions to upload any content to the Service, and that your content does not infringe the intellectual property, privacy, or contractual rights of any third party.
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. SafetySmartAI does not warrant that the Service will be uninterrupted, error-free, secure, or that AI-generated content will be accurate or suitable for your specific circumstances.
SafetySmartAI reserves the right to suspend, restrict, or terminate your access to the Service at our sole discretion, without notice, if we believe you have violated these Terms, applicable law, or the rights of others, or if your use poses a risk to the Service, other users, or any third party. Upon termination, your right to use the Service ceases immediately.
You agree to indemnify, defend, and hold harmless SafetySmartAI, its creators, affiliates, officers, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, your violation of any law or third-party rights, or any content you upload or generate through the Service.
To the maximum extent permitted by law, SafetySmartAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunity.
We reserve the right to modify these terms at any time. Continued use of the Service following any changes constitutes acceptance of the new terms. We will notify users of material changes via email or in-app notice.
These Terms shall be governed by and construed in accordance with the laws of the United States and the State in which National Safety Consultants Inc. is incorporated, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in that State for any disputes arising out of or relating to these Terms or the Service.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association under its commercial arbitration rules, rather than in court, except that either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information. The arbitration shall be conducted in the State specified in the Governing Law section. Judgment on the award rendered may be entered in any court having jurisdiction. You waive any right to participate in a class action or class-wide arbitration.
You may not use, export, or re-export the Service in violation of any applicable export control laws or regulations, including the U.S. Export Administration Regulations and economic sanctions administered by the U.S. Treasury Department. You represent that you are not located in, under the control of, or a national of any country subject to comprehensive U.S. sanctions, and that you are not on any restricted-party list (including the Specially Designated Nationals list).
SafetySmartAI shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, epidemics or pandemics, labor disputes, internet or infrastructure outages, AI provider downtime, acts of terrorism, or governmental actions. We will use reasonable efforts to resume performance as soon as practicable.
Nothing in these Terms creates any partnership, joint venture, agency, fiduciary, or employment relationship between you and SafetySmartAI. You act on your own behalf and not as an agent or representative of SafetySmartAI when using the Service, including when generating documents or providing guidance to third parties such as contractors, clients, or employees.
The Service may reference, cite, or link to regulations, standards, third-party websites, and external resources. SafetySmartAI does not control and is not responsible for the accuracy, availability, or content of any third-party material. Any reliance on third-party content is at your own risk. Inclusion of a link or reference does not imply endorsement.
You may not assign, transfer, or sublicense your account or these Terms to any other party without our prior written consent. SafetySmartAI may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, or sale of all or a portion of our assets. Any attempted assignment in violation of this section is void.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and SafetySmartAI regarding the Service and supersede all prior or contemporaneous agreements. If any provision of these Terms is held to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
SafetySmartAI will comply with applicable laws requiring disclosure that content is generated by artificial intelligence, including the EU AI Act and applicable U.S. state AI transparency laws. Where required, AI-generated content will be labeled or disclosed as such. We reserve the right to implement additional transparency measures as legal requirements evolve.
